service 401(k) programs are constantly changing and the CFDD encourages
provider interface to ensure accuracy. The CFDD also offers providers
a Provider Forum to critique our analysis and announce product enhancements.

Only individuals authorized by the CFDD may access our competitive analysis.
Subscribers are granted revocable, nonexclusive, nontransferable, limited
access to our analysis for product development and broker due diligence
purposes only.
The
CFDD's competitive analysis is for provider and broker-dealer use only
and may not be copied for distribution or used in the sales process
with plan sponsors under any circumstances.
Authorized
wholesalers and brokers may, however, use the CFDD's competitive analysis
for program due diligence. Authorized wholesalers may also copy and
distribute to brokers our review of their "proprietary" program
without restrictions. Authorized wholesalers may not, however, copy
or distribute reviews of competing full service programs to brokers
or plan sponsors.
Unauthorized
users agree to pay for CFDD $5,000 on-demand for each online access.
Subscribers
using our analysis in an unauthorized manner, i.e., copying for distribution
or in the plan sponsor sales process, also agree to pay the CFDD $5,000
for each offense.
Subscribers
and unauthorized users that use our competitive analysis as unauthorized
sales material with plan sponsors may also face NASD issues if they
are registered and face civil and/or criminal liability.
The
CFDD reserves the right to suspend services to subscribers using our
competitive analysis in an unauthorized manner and pursue any and all
available legal remedies.
The
CFDD also reserves the right to delete or change passwords and users
agree to be responsible for the confidentiality of their password. Users
also agree to notify the CFDD if they believe their password has been
compromised.
Sponsors,
consultants, the media and competing service providers may not access
our competitive analysis under any circumstances without CFDD's written
permission.
The
terms and conditions of this agreement should be governed by and construed
in accordance with the laws of the State of Illinois, exclusive of its
choice of laws provisions.
FORUM
POSTINGS, LINKS & ADVERTISING
The CFDD is not responsible for screening, policing or editing postings
on our Provider or Broker Forum. At their sole discretion, the CFDD
does, however, reserve the right to delete postings that are deemed
inappropriate, offensive, unlawful or "off-topic" for the
site.
The
CFDD may post third party advertising on their site, but is not liable
for content, accuracy or any loss or damage from dealings between users
and advertisers.
The
CFDD may provide links to other sites for the convenience of users,
but such sites have not been reviewed, and are not endorsed by CFDD.
CFDD is in no way responsible for the content, or use, of these sites
and the CFDD disclaims any and all responsibility for content or use.
Third
party advertising, forum postings and links should also not be construed
as an endorsement by the CFDD.
